![]() A inobservância desses critérios pode acarretar subjetividade nas decisões, passível de suscitar controle tanto no âmbito interno quanto externo. Razoabilidade, proporcionalidade, adoção nos casos de riscos graves e irreversíveis, motivação expressa, reavaliação periódica das decisões e participação da sociedade sob a perspectiva democrática são alguns dos critérios sugeridos para balizar a aplicação do princípio da precaução. Constata-se que houve distorções no significado de precaução, abrindo caminho para a sua utilização como fundamento de decisões autoritárias e desprovidas de argumentos cientificamente consistentes, muitas vezes impregnadas de caráter ideológico e subjetivo, acarretando insegurança jurídica. RESUMO O presente trabalho pretende identificar e propor a utilização de critérios de aplicação do princípio da precaução. DIREITO INTERNACIONAL DO MEIO AMBIENTE: PARTICULARIDADES RESUMO O artigo examina os instrumentos jurídicos disponíveis no âmbito do Direito internacional para a proteção do meio ambiente, buscando demonstrar que existe, em formação, um Direito Internacional do Meio Ambiente, o qual começa a ser afirmar. The article also highlights the political, social and economic difficulties for the effectiveness and implementation of this new branch of international law. the change of concepts of responsibility and sovereignty, the wide use of principles and the gradual transformation of the subjects of Public International Law. The article highlights some of these modifications, e.g. The International Environmental Law is a new Law, which, however, has brought important news to the international legal order. Throughout the article, we analyze the main characteristics able to mark the peculiar position of this branch in the construction of the international legal order. The article analyzes the legal instruments available under international law for the protection of the environment, seeking to show that there is an International Environmental Law in formation, which is beginning to be affirmed. ![]() As a result, the conclusion is that there is an overuse of the precautionary principle by the Brazilian courts, especially by the Superior Court of Justice and that, in this case, the Federal Supreme Court has played a moderating role in relation to the application of the precautionary principle. The methodology to be used is the research of the case law and relevant legal rules, as well as the examination of the scholarly production on the subject. The hypothesis being examined is that since the Rio Declaration's-in its translation into Portuguese-environmental legislation has termed as legal principle, which internationally is an approach, a precautionary measure, as can be seen in both the texts in English and French of the Rio Declaration and other relevant legal instruments. ![]() However, it follows that its application has been made fairly randomly, and even so there is no clear and operational definition of its content. As it is beknown, this principle has been widely cited by Brazilian case law and it is an important part of the legal and environmental scholarly production. ![]() The problem to be addressed in this article is related to the precautionary principle and its incorporation into the Brazilian law.
